Welcome to the Chargedef. By using our platform, you (hereafter "CONTRACTOR" or "MERCHANT") accept and agree with the terms and conditions described below. These terms govern the use of the software of automation of digital evidence provided by the Chargedef.

1. Service Object
The Chargedef is a software as a service (SaaS) platform that automates the collection of digital traces and the generation of dossiers in PDF format to assist the merchant in chargeback disputes together with payment gateways.
2. Disclaimer of Responsibility for the Result (Obligation of Means)
2.1 No Guarantee of Reversal
The Chargedef provides tools to strengthen the defense of the merchant. However, the final decision on the acceptance of evidence and the reversal of the chargeback is exclusively the responsibility of the card issuer and the payment gateway. The Chargedef DOES NOT GUARANTEE, under any circumstances, that the use of your dossiers will result in victory in financial disputes.
2.2 Financial Losses
The Chargedef will not be responsible for any financial losses, damages, lost profits or damages resulting from chargebacks that have not been reversed, regardless of the quality of the evidence generated.
3. Dependency on Third Parties and APIs
3.1 Payment Gateways
The operation of the Chargedef depends on the availability and stability of the third-party APIs (e.g. Efi, Stripe, etc.). The Chargedef is not responsible for data collection failures resulting from instabilities, technical changes or unavailability of the services of these gateways.
3.2 Certificates and Credentials
The MERCHANT is the only one responsible for providing, updating and ensuring the validity of digital certificates (such as the .p12 of Efi) and API keys. Failures in the generation of dossiers due to invalid credentials are the sole responsibility of the MERCHANT.
4. Accuracy and Technical Limitations
4.1 Blockers and Interferences
The MERCHANT recognizes that the capture of data (IP, digital trace, behavior) can be impeded by technologies of the final user, such as AdBlockers, VPNs, firewalls or restrictive browser settings. The Chargedef does not guarantee the capture of 100% of the data in these circumstances.
4.2 Uptime
The Chargedef seeks to maintain 99% availability, but does not guarantee that the system will be uninterrupted or free of errors. Preventive maintenance or cloud infrastructure failures do not generate a right to indemnification.
5. Retention and Deletion of Data
5.1 365 Days Period
The evidence and dossiers generated will be stored and available for download for a period of 365 (three hundred and sixty-five) days counted from the date of the transaction.
5.2 Definitive Deletion
After the mentioned period, the Chargedef will permanently delete the files for compliance with the LGPD and storage management. It is the responsibility of the MERCHANT to perform external backup of its dossiers if it wishes to keep them for a period longer.
6. Acceptable Use
6.1 Accuracy
The MERCHANT commits to using the tool only for legitimate transactions. It is strictly prohibited to use the Chargedef to forge evidence or perform any fraudulent activity.
6.2 Intellectual Property
The MERCHANT will not be able to perform reverse engineering, copying or attempt to access the source code of the tracking script or the PDF generation engine.
7. Payment and Cancellation
7.1 Subscription
Access is granted by prior payment of the chosen plan. Defaulting will result in immediate suspension of data collection and generation of new dossiers.
7.2 Cancellation
The cancellation can be done at any time by the panel, interrupting the renewal for the next cycle, without the right to refund periods already used.
8. Limitation of Indemnification
In any event of proven civil liability, the maximum indemnification due to the Chargedef by the MERCHANT will be limited to the equivalent value of the 3 (three) last monthly payments paid by the MERCHANT before the harmful event.
9. Forum
The forum of the comarca of [YOUR CITY/STATE] is elected to resolve any controversies arising from this term, with the renunciation of any other, regardless of how privileged it may be.
